In 2014 Jennifer Cramblett, a white lesbian, filed a Complaint for Wrongful Birth alleging that the Midwest Sperm Bank mistakenly provided sperm from an African–American donor. In this article, we trace the complex and overlapping lines of legal and social inheritance that have conditioned not only the possibility of such a lawsuit, but also the legal language and arguments within the Complaint itself. First, we trace the racial politics of homonormativity, which set the conditions of possibility for an out, white (...) lesbian to bring this case forward. Second, we trace the inheritance of wrongful birth tort law, reviewing its prior race and disability-related uses, and its basis in feminist reproductive rights. Third, we trace how disability, race and sexuality interlock within the eugenic inheritance of both ‘wrongful birth’ and reproductive technologies. Finally, we follow traces of racial inheritance, namely, the loss of white property and proximity to whiteness. (shrink)

We investigate what distinguishes social entrepreneurial ecosystems (SEEs) from entrepreneurial ecosystems (EEs) through appreciation of the importance of context—the multiplex of intertwined social, spatial, temporal, historical, cultural, and political influences. Community is incorporated as a key variable and hitherto overlooked dimension of the structure and influence of SEEs. We draw on extant literature and examples of a variety of SEEs to support our propositions and demonstrate why considerations of both context and community are critical to advance understanding of SEEs. We (...) contribute to the study of SEEs by presenting a new conceptual framework and theorizing SEE as an evolving composite of interdependent actors who interact and collaborate across multiple levels to collectively generate positive externalities and drive sustainable solutions to social problems. The House of Lords ruled in R v Howe (1987) that Duress is not a defence to murder in English law. Some of the central arguments rested on a simple view about the nature of duress and the way in which duress is relevant in moral evaluation. This paper discusses legal and non-legal senses of duress, and argues that duress can be relevant to moral evaluation in a number of different ways. Some acts under duress are morally justified (here the (...) defence of Duress is like that of Necessity) and some others are excusable; some excuses deny full responsibility on the part of the agent (here Duress is more like Provocation) and others do not. The judicial description of duress in Howe is too specific to notice this, with the consequence that some of the central claims made in dismissing Duress as a defence to murder are confused. The personality and the writings of Marsilio Ficino mark the turning point from the middleages to the Renaissance. In John Marenbon’s apt description, medieval philosophy is ‘the story of a complex tradition founded in Neoplatonism, but not simply as a continuation or development of Neoplatonism itself’. ‘Not simply’ because the Enneads, the first and finest flowering of that tradition, testify to Plotinus’ deep engagement, not only with the thought of Plato, Aristotle, the Stoics and the Middle Platonists, but also with (...) a variety of theologico-mystical writings of diverse middleeastern provenances, from Egypt to Persia. This complex tradition, Ficino transmitted to the West in the form of translations from Greek into Latin of the dialogues of Plato and the Enneads of Plotinus as well as of several commentaries on those texts by later thinkers. In addition to such exegetical works, Ficino wrote several philosophical treatises of his own. Finally, as an ordained priest, he was also well acquainted with the writings of the Church Fathers, all of which had contributed to his belief that religion should not be separated from philosophy. To the completion of this ambitious scholarly programme and the fulfilment of his commitment to the Church, he brought the resources of his powerfully syncretistic mind. Rather than merely combining various texts and traditions, he made them speak to each other and, in the process, evolved a system that was both sui generis and attuned to the new ways of thinking that were then emerging in quattrocento Florence. His in-depth understanding of all these texts, together with his ability to spot similarities, analogies and correspondences between them, enabled him to fuse into a coherent system various elements which a modern historian of philosophy would regard as dissimilar if not incompatible. His philosophical acumen enabled him, when he thought it appropriate, to improve on the views of those he regarded as his masters and to fill whatever gaps he found in their arguments. The present essay is an attempt to unravel the nature of Ficino’s syncretism, in which three levels of widening scope will be distinguished: authorial, trans-authorial and trans-doctrinal. To achieve a desirable level of both precision and concision, a short text will then be analysed, namely Speech Five of his most widely read treatise, a Latin commentary on Plato’s Symposium, entitled Commentarium in Convivium Platonis De Amore. It will be shown how, through the fictional speech that he put in the mouth of Marsuppini, his chosen spokesperson of the Platonic Agathon, Ficino succeeded, not only in blending Platonic, Plotinian and Christian elements in the reconstruction of an argument that Plato had meant us to regard as flawed to the core, but he also composed an elegant and original speech that continues to intrigue and enchant its readers after a gap of over six centuries. Previous research suggests that exposure to nature may reduce delay discounting and thereby facilitate healthier dietary intake. This pre-registered study examined the impact of online exposure to images of natural scenes on delay discounting and food preferences. It was predicted that exposure to images of natural scenes would be associated with: lower delay discounting; higher desirability for fruits and vegetables ; and delay discounting would mediate the effect of nature-image exposure on food desirability. Adult participants were recruited to an online (...) between-subjects experiment in which they viewed a timed sequence of six images either showing natural landscape scenes or urban scenes. They then completed measures of mood, delay discounting and rated their momentary desire to eat four fruits and vegetables, and four energy-dense foods. There was no statistically significant effect of experimental condition on delay discounting or food desirability. Bayes factors supported the null hypothesis for discounting, and energy-dense food desirability, but provided no strong evidence for either hypothesis for F&V desirability. These findings indicate that brief online exposure to images of nature does not affect momentary impulsivity or energy-dense food preference, whereas for preference for less-energy dense foods, the evidence was inconclusive. Responsible conduct of research courses are widely taught, but little is known about the purposes or effectiveness of such courses. As one way to assess the purposes of these courses, students were surveyed about their perspectives after recent completion of one of eleven different research ethics courses at ten different institutions. Participants enrolled in RCR courses in spring and fall of 2003 received a voluntary, anonymous survey from their instructors at the completion of the course. Responses were received from 268 (...) participants. Seventy-seven percent of open-ended responses listed specific kinds of information learned; only a few respondents talked about changes in skills or attitudes. The perception that courses did more to provide information than to foster skills or attitudes was verified in quantitative responses. Over 75% of the respondents specifically noted that courses were useful in preparing them to recognize, avoid, and respond to research misconduct. The two principal findings of this multi-institutional study are that respondents reported: a wide variety of positive outcomes for research ethics courses, but that the impact on knowledge was greater than that for changes in skills or attitudes. This article presents an ethics support instrument for healthcare professionals called CURA. It is designed with a focus on and together with nurses and nurse assistants in palliative care. First, we shortly go into the background and the development study of the instrument. Next, we describe the four steps CURA prescribes for ethical reflection: (1) Concentrate, (2) Unrush, (3) Reflect, and (4) Act. In order to demonstrate how CURA can structure a moral reflection among caregivers, we discuss how a case (...) was discussed with CURA at a psychogeriatric ward of an elderly care home. Furthermore, we go into some considerations regarding the use of the instrument in clinical practice. Finally, we focus on the need for further research on the effectiveness and implementation of CURA. (shrink)

Moral distress forms a major threat to the well-being of healthcare professionals, and is argued to negatively impact patient care. It is associated with emotions such as anger, frustration, guilt, and anxiety. In order to effectively deal with moral distress, the concept of moral resilience is introduced as the positive capacity of an individual to sustain or restore their integrity in response to moral adversity. Interventions are needed that foster moral resilience among healthcare professionals. Ethics consultation has been proposed as (...) such an intervention. In this paper, we add to this proposition by discussing Moral Case Deliberation (MCD) as a specific form of clinical ethics support that promotes moral resilience. We argue that MCD in general may contribute to the moral resilience of healthcare professionals as it promotes moral agency. In addition, we focus on three specific MCD reflection methods: the Dilemma Method, the Aristotelian moral inquiry into emotions, and CURA, a method consisting of four main steps: Concentrate, Unrush, Reflect, and Act. In practice, all three methods are used by nurse ethicists or by nurses who received training to facilitate reflection sessions with these methods. We maintain that these methods also have specific elements that promote moral resilience. However, the Dilemma Method fosters dealing well with tragedy, the latter two promote moral resilience by including attention to emotions as part of the reflection process. We will end with discussing the importance of future empirical research on the impact of MCD on moral resilience, and of comparing MCD with other interventions that seek to mitigate moral distress and promote moral resilience. Access to treatment, in HIV vaccine trials (HVTs), remains ethically controversial. In most prevention trials, including in South Africa, participants who seroconvert are referred to publicly funded programmes for treatment. This strategy is problematic when there is inadequate and uneven access to public sector antiretroviral therapy (ART) and support resources. The responsibilities, if any, of researchers, sponsors and public health authorities involved in HVTs has been hotly debated among academics, scholars, representatives of international organizations and sponsors. However, there is little (...) published on community perceptions. Recent guidance asserts that communities should make inputs into treatment and care decisions. This qualitative study explored a South African community's perceptions of who should provide what to HVT participants as well as how and why this should be done. Twenty-nine adults working at or attending five primary health care clinics in two rural areas in KwaZulu-Natal participated in in-depth interviews. Respondents expressed that researchers should ‘help participants to access’ treatment and care ‘because they are in a position to do so’ and ‘are in a relationship with’ trial participants. Respondents suggested that researchers could help by ‘facilitating referral’ until such time that participants can access care and treatment on their own. We highlight a series of implications for researchers in HVTs, including their need to be aware of prospective participants' considerable trust in and respect for researchers, the responsibility that this places on them, and the need for clear communication with communities so as not to erode community trust. Indonesia, an archipelagic country with 17 000 islands with 281 million inhabitants, is a democratic country with Islam as the major religion. Currently, Indonesia is the second country with the largest Muslim population in the world. The Islamic tradition in Indonesia has assimilated and intersected with the richness and diversity of Indonesian culture. This is reflected in the use and meaning of Islamic concepts in Indonesia, such as ikhtiar. Ikhtiar is important to Indonesian Muslims and may have profound ethical implications (...) in palliative care situations. This makes it a relevant term to understand for healthcare professionals and adds to our vocabulary in medical ethics. This column will demonstrate the meaning and origin of ikhtiar, how it may be used in a palliative care setting, and its relationship with other concepts. The word ikhtiar is etymologically derived from Arabic اِخْتِيَار ( iḵhtiyār ) and is included in the Official Dictionary of Bahasa Indonesia. It means ‘free choice’ in Arabic, emphasising the capacity of mankind to determine their own course of action rather than predestination. However, in Indonesia, ikhtiar has a more specific nuance as a verb, meaning ‘making an effort’. It denotes that, as a consequence of having free will, humans can choose the goal which they perceive to be the best, and subsequently, make an effort to reach that goal. Contrary to the assumptions of empiricist philosophies of science, the theory-laden character of data will not imply the inherent failure (subjectivity, circularity, or rationalization) of instruments to expose nature's secrets. The success of instruments is credited to scientists' capacity to create artificial technological analogs to familiar physical systems. The design of absorption spectrometers illustrates the point: Progress in designing many modern instruments is generated by analogically projecting theoretical insights from known physical systems to unknown terrain. An experimental realism is defended.

Plato's "Ion," despite its frail frame and traditionally modest status in the corpus, has given rise to large exegetical claims. Thus some historians of aesthetics, reading it alongside page 205 of the Symposium, have sought to identify in it the seeds of the post-Kantian notion of 'art' as non-technical making, and to trace to it the Romantic conception of the poet as a creative genius. Others have argued that, in the "Ion," Plato has Socrates assume the existence of a technē (...) of poetry. In this article, these claims are challenged on exegetical and philosophical grounds. To this effect, Plato's use of poiētēs and poiēsis in the Symposium is analysed, the defining criteria of technē in the "Ion" and other dialogues are identified and discussed, and the 'Romantic' interpretation of the dialogue is traced to Shelley's tendentious translation of it. These critical developments lead to what is presented as a more faithful reading of the dialogue. In the "Ion," it is claimed, Plato seeks to subvert the traditional status of poetry by having Socrates argue that poetry is both non-rational and non-cognitive in nature. In the third part of the article, suggestions are offered as to the contribution made by the "Ion" to the evolution of Plato's reflections on poetic composition, and particularly as to the reasons which later induced Plato to substitute the concept of mimesis for that of inspiration in his account of poetry. Orienting biases for speech may provide a foundation for language development. Although human infants show a bias for listening to speech from birth, the relation of a speech bias to later language development has not been established. Here, we examine whether infants' attention to speech directly predicts expressive vocabulary. Infants listened to speech or non-speech in a preferential listening procedure. Results show that infants' attention to speech at 12 months significantly predicted expressive vocabulary at 18 months, while indices of general (...) development did not. No predictive relationships were found for infants' attention to non-speech, or overall attention to sounds, suggesting that the relationship between speech and expressive vocabulary was not a function of infants' general attentiveness. Potentially ancient evolutionary perceptual capacities such as biases for conspecific vocalizations may provide a foundation for proficiency in formal systems such language, much like the approximate number sense may provide a foundation for formal mathematics. The interpretation given by Craik and Lockhart of the findings by Hyde and Jenkins involving supposed depth of incidental-task processing on subsequent word recall is brought into question by the tenets of logical learning theory. It is shown that Craik and Lockhart overlooked the possible role of oppositionality in this research. An alternative explanation relying on an oppositional context and predication is offered. Two experiments present evidence supporting the hypothesis that oppositionality in an incidental task facilitates subsequent word recall . (...) In both experiments, the importance of taking a subject's meaningful understanding of the task instruction into consideration is highlighted. The discussion contrasts Boolean "binary" disjunction with the logic of oppositionality. It is shown how oppositionality allows us to conceptualize a testable theory of human agency. (shrink)
